Why can drunk women cry ?

If she's too drunk to say no then the guy (or other woman) should not ume it's a yes. Oddly enough no matter how drunk she is if she commits a crime she can't say i was too drunk to know I was committing a crime. They just add public intoxication or drunk and disorderly conduct to the charges.
